These Terms of Service ("Terms") govern access to and use of www.us360view.com (the "Website") and, where applicable, professional services provided by Loyola Branding, LLC, doing business as US360VIEW ("US360VIEW," "Company," "we," "us," or "our").

US360VIEW provides private utility locating, Ground Penetrating Radar ("GPR"), electromagnetic locating ("EML"), concrete scanning, subsurface utility mapping, GPS/GNSS and GIS mapping, Subsurface Utility Engineering ("SUE") support, utility daylighting/potholing coordination, and related subsurface investigation and documentation services.

By accessing this Website, requesting a quote, submitting a project or RFP request, accepting a proposal, issuing a purchase order, authorizing mobilization, or otherwise engaging US360VIEW to perform Services, you acknowledge that you have read and agree to these Terms, subject to any separately executed Professional Services Agreement, proposal, work order, master services agreement, purchase order, or other written agreement between US360VIEW and the Client.

1. Professional Services

US360VIEW provides subsurface investigation, utility locating, mapping, scanning, and related professional field services for clients in industries including:

  • General construction
  • Civil engineering and infrastructure
  • Oil and gas
  • Pipelines and facilities
  • Renewable energy
  • Solar, wind, and Battery Energy Storage Systems ("BESS")
  • Electric transmission and distribution
  • Commercial and industrial facilities
  • Municipal infrastructure
  • Geotechnical and environmental investigations
  • Concrete scanning
  • Subsurface Utility Engineering

The specific scope, project limits, deliverables, schedule, pricing, assumptions, and exclusions for each project will be identified in the applicable proposal, Professional Services Agreement ("PSA"), work authorization, purchase order, or other written project document.

Services not specifically included in the agreed scope are excluded unless subsequently authorized in writing.

2. Order of Precedence

These Terms establish general conditions applicable to the Website and US360VIEW Services.

When US360VIEW and a Client execute a separate Professional Services Agreement, proposal, master services agreement, work order, or other mutually accepted written contract, that project-specific agreement will govern the applicable project.

If a conflict exists between these Website Terms and a separately signed agreement with US360VIEW, the separately signed agreement will control to the extent of the conflict.

Terms contained in a Client purchase order, vendor portal, acknowledgment, email, or other document do not modify US360VIEW's terms unless US360VIEW expressly agrees to the modification in writing.

3. Nature and Limitations of Utility Locating

Private utility locating, Ground Penetrating Radar, electromagnetic locating, concrete scanning, and other subsurface investigation methods are investigative processes and are not guarantees that every underground or embedded object will be detected.

Subsurface conditions are inherently uncertain.

Detection may be affected by factors including, but not limited to:

  • Soil composition
  • Clay, caliche, rock, or highly conductive soils
  • Moisture conditions
  • Groundwater
  • Utility depth
  • Utility diameter
  • Utility material
  • Congested utility corridors
  • Electromagnetic interference
  • Reinforcing steel
  • Surface obstructions
  • Concrete thickness
  • Limited site access
  • Utility construction methods
  • Broken or missing tracer wire
  • Poor grounding
  • Abandoned utilities
  • Undocumented utilities
  • Closely spaced utilities
  • Non-metallic or non-conductive infrastructure
  • Depth beyond equipment range

US360VIEW does not warrant or guarantee complete detection of all subsurface objects.

4. Ground Penetrating Radar Limitations

GPR is a non-destructive geophysical method that interprets subsurface reflections. Results depend on site conditions and are not absolute measurements.

5. Electromagnetic Locating Limitations

EML requires conductive utilities or tracer wire. Non-metallic or damaged utilities may not be detectable.

6. Private Utility Locating and Texas 811

US360VIEW does not replace 811 requirements. Clients must contact Texas 811 before excavation when required by law.

7. Client Responsibilities

Clients must provide accurate site information, access, and known utility data and ensure safe working conditions.

8. Area of Investigation

Work is limited to the agreed Area of Concern. Expansion requires authorization.

9. Markings

Utility markings are temporary and may degrade or become inaccurate over time.

10. Excavation Responsibility

The Client is solely responsible for excavation decisions and verification before digging.

11. Subsurface Utility Engineering

SUE services are provided only when explicitly included in scope and agreement.

12. Utility Daylighting

Exposure work may require additional authorization depending on site conditions.

13. Mapping Deliverables

GIS, GPS, CAD, and mapping outputs are not legal surveys unless explicitly stated.

14. Reports

Reports reflect conditions at time of service and may become outdated.

15. Third-Party Data

US360VIEW is not responsible for accuracy of third-party utility records.

16. Concrete Scanning

No scan guarantees absence of embedded objects.

17. Site Safety

Client is responsible for site safety and hazard disclosure.

18. Scheduling

Schedules are estimates and subject to delays outside US360VIEW control.

19. Payment

Invoices are Net 30 unless otherwise agreed. Additional work may incur additional charges.

20. Changes in Scope

Changed conditions may require additional compensation or schedule adjustments.

21. Cancellation

Cancellation fees may apply after mobilization.

22. No Guarantee of Damage Prevention

Services reduce risk but do not eliminate it.

23. Disclaimer

Services are provided without warranties except as required by law.

24. Limitation of Liability

US360VIEW is not liable for indirect or consequential damages to the fullest extent permitted by law.

25. Indemnification

Indemnity obligations apply only as permitted by law and written agreement.

26. Confidentiality

Client data is protected using reasonable commercial efforts.

27. Intellectual Property

All Website content belongs to US360VIEW unless otherwise stated.

28. Acceptable Use

Users may not misuse the Website or submit false information.

29. Website Information

Website content is general information only.

30. Third-Party Links

US360VIEW is not responsible for third-party websites.

31. Independent Contractor

No employment or partnership relationship is created.

32. Governing Law

These Terms are governed by the State of Texas.

33. Severability

If any provision is invalid, the rest remains in effect.

34. Waiver

Failure to enforce does not waive rights.

35. Entire Agreement

These Terms combined with project agreements form the full agreement.

36. Changes

US360VIEW may update these Terms at any time.
